Terms of Service

Effective July 21, 2026. These terms govern your use of Your Potential AI, operated by Official Intelligence Technologies, Inc.

1. Eligibility and agreement

You must be at least 18 years old, or the legal age of majority where you live, and able to enter a binding contract. By creating an account, purchasing a plan, or using the service, you agree to these terms and our Privacy Policy.

2. Accounts and security

Provide accurate information, keep your credentials secure, and promptly notify security@yourpotentialai.com if you suspect unauthorized access. You are responsible for activity under your account except to the extent caused by our breach of these terms or applicable law.

3. Acceptable use

You may not use the service to violate law or third-party rights; create or distribute illegal, infringing, deceptive, hateful, or harmful material; send spam, phishing, or unsolicited communications; access another user's data; introduce malicious code; disrupt the service; bypass security, rate, or plan controls; or reverse engineer protected systems except where applicable law expressly permits it.

4. AI output and professional decisions

AI output may be inaccurate, incomplete, outdated, or unsuitable. The service assists your work but does not provide legal, tax, medical, investment, accounting, grant-award, or other professional advice. You are responsible for reviewing output, confirming facts, obtaining professional advice when appropriate, and deciding whether to publish or act on it.

5. Connected services

Third-party services are governed by their own terms and may change or become unavailable. You authorize us to exchange information with a connected service only as needed to provide the connection and carry out supported actions you request. We are not responsible for third-party services.

6. Plans, billing, and cancellation

Paid plans renew monthly until canceled. Current prices, limits, and included features appear on the Pricing page and at checkout. Taxes may apply. Cancel through the billing portal before renewal to prevent the next charge; access continues through the paid billing period unless law requires otherwise. Refunds are governed by our Refund Policy. We may change future pricing or plan features with reasonable advance notice.

7. Your content and feedback

You retain your rights in content you submit. You grant us a worldwide, non-exclusive license to host, copy, process, transmit, and display that content only as needed to provide, secure, support, and improve the service. You represent that you have the rights and permissions needed to submit it. If you provide feedback, we may use it without restriction or compensation.

8. Our service and intellectual property

Your Potential AI, its software, branding, design, and related intellectual property belong to Official Intelligence Technologies, Inc. or its licensors. Except for the limited right to use the service under these terms, no rights are transferred to you.

9. Suspension and termination

You may stop using the service at any time. We may suspend or terminate access for a material breach, unlawful activity, security risk, nonpayment, or where required by law. Where practical, we will provide notice and an opportunity to cure. Provisions that by their nature should survive termination will survive.

10. Disclaimers and limitation of liability

To the maximum extent permitted by law, the service is provided "as is" and "as available" without implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted service, business results, funding, revenue, or the accuracy of AI output.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Our aggregate liability relating to the service will not exceed the greater of USD $100 or the amount you paid us during the twelve months before the event giving rise to the claim. These limits do not apply to death or bodily injury caused by gross negligence, fraud, willful misconduct, or liability that applicable law does not allow us to limit.

11. Indemnification

To the extent permitted by law, you will defend and indemnify Official Intelligence Technologies, Inc. against third-party claims arising from your content, your unlawful misuse of the service, or your material violation of these terms.

12. Governing law and disputes

These terms are governed by Delaware law, without regard to conflict-of-law rules. Except for eligible small-claims matters, requests for injunctive relief, and disputes that cannot legally be arbitrated, disputes will be resolved by individual binding arbitration administered by the American Arbitration Association under its applicable rules in New Castle County, Delaware. You and we waive jury trial and class, collective, and representative proceedings to the fullest extent permitted by law. Mandatory consumer rights and forums in your jurisdiction still apply.

13. Copyright and DMCA

We respect intellectual-property rights. A copyright owner or authorized agent may send a compliant takedown notice to dmca@official-intelligence.com identifying the copyrighted work, the material and its location, contact information, a good-faith unauthorized-use statement, an accuracy and authority statement made under penalty of perjury, and a physical or electronic signature. We may remove material and notify the affected user; a user may submit a legally compliant counter-notice to the same address.

14. Severability

If a provision is held unenforceable, it will be enforced to the greatest lawful extent and the remaining provisions will remain in effect.

15. Changes and contact

We may update these terms as the service or law changes. We will post the revised terms and update their effective date, and provide additional notice for material changes when required. Questions may be sent to legal@yourpotentialai.com.
